Les r\u00e8gles g\u00e9n\u00e9rales en mati\u00e8re de logement \u00e9nonc\u00e9es ci-dessous s\u2019appliquent donc <strong>\u00e9galement aux kots<\/strong>.<\/p>\n<p>Pour pouvoir mettre un kot en location, le propri\u00e9taire doit respecter <strong>certaines r\u00e8gles<\/strong>. \u00c0 Bruxelles, il s\u2019agit principalement du Code bruxellois du Logement <strong>(CBL)<\/strong>, du R\u00e8glement R\u00e9gional d\u2019Urbanisme <strong>(RRU)<\/strong> et des R\u00e8glements Communaux d\u2019Urbanisme <strong>(RCU)<\/strong>. Chacun s\u2019applique \u00e0 <strong>des situations diff\u00e9rentes<\/strong>. De plus, ils ont <strong>leurs propres normes minimales<\/strong> dans certains cas. Par cons\u00e9quent, les r\u00e8gles qui s\u2019appliquent \u00e0 Bruxelles, en Flandre et en Wallonie peuvent \u00eatre diff\u00e9rentes. Le l\u00e9gislateur bruxellois a introduit quelques changements importants. <strong>Il existe des r\u00e9gimes locatifs distincts<\/strong>: le bail \u00e9tudiant, le bail de colocation et le bail glissant.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le CBL concerne <strong>la qualit\u00e9<\/strong> de chaque logement lou\u00e9. Les obligations \u00e9num\u00e9r\u00e9es dans le CBL et ses arr\u00eat\u00e9s d\u2019ex\u00e9cution portent sur <strong>la s\u00e9curit\u00e9, la sant\u00e9 et l\u2019\u00e9quipement<\/strong> du logement. C\u2019est la Direction de l\u2019Inspection R\u00e9gionale du Logement du Service public r\u00e9gional de Bruxelles qui contr\u00f4le ces obligations. En cas de non-respect des r\u00e8gles, la DIRL peut interdire de continuer \u00e0 mettre le bien en location. Si vous souhaitez mettre des kots en location, vous devez demander <strong>un permis d\u2019urbanisme<\/strong> dans la plupart des cas, que ce soit pour une nouvelle construction ou pour la location de chambres dans un b\u00e2timent existant.<\/p>\n<p>La R\u00e9gion de Bruxelles-Capitale a instaur\u00e9 un R\u00e8glement R\u00e9gional d\u2019Urbanisme. Dans certains cas, celui-ci est <strong>compl\u00e9t\u00e9<\/strong> par un R\u00e8glement Communal d\u2019Urbanisme. Si vous ne le faites pas, vous risquez une amende.<\/p>\n<p>De plus, <strong>les kots<\/strong> ne sont actuellement <strong>pas r\u00e9pertori\u00e9s comme une cat\u00e9gorie distincte<\/strong>. Ils doivent donc r\u00e9pondre aux normes relatives aux logements \u00ab ordinaires \u00bb. Des d\u00e9rogations aux prescriptions urbanistiques sont possibles, mais \u00e0 condition d\u2019introduire une demande. Vous y trouverez aussi un aper\u00e7u des r\u00e8gles applicables.<\/p>\n<p>Jusqu\u2019\u00e0 pr\u00e9sent, le RRU de 2006 s\u2019applique. Depuis 2019, le gouvernement bruxellois est en train d\u2019\u00e9laborer <strong>un nouveau r\u00e8glement<\/strong> en mati\u00e8re d\u2019urbanisme, sous l\u2019appellation &lsquo;Good Living&rsquo;.
